LEGALITY: It is your responsibility to know the legality of the items you are ordering. Some items may be restricted to adults and/or may be restricted due to the area in which you reside. These items include, but are not limited to, ammunition, firearms, and magazines. By entering into a transaction with Seventh Sea Industries, LLC (dba Fir Doiteain Armory), you acknowledge, agree to and accept our terms and conditions.
CUSTOMER AFFIDAVIT:
I am currently twenty-one (21) years of age or older.
By selling or delivering product to me, Fir Doiteain Armory is not violating any State or local law or ordinance.
I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for which the judge could have imprisoned me for more than one year.
I am not a fugitive from justice.
I am not an unlawful user of or addicted to any controlled substance.
I have not been adjudicated mentally defective and/or I have never been committed to any mental institution.
I am not an illegal or unlawful alien.
I have never been or expect to be discharged from the Armed Forces under dishonorable conditions.
I have not renounced my citizenship of the United States of America.
I am not currently subject to a restraining order of any kind from any court.
I have never been or expect to be convicted in any court of a misdemeanor crime of domestic violence.
ASSUMPTION OF SHIPPING LIABILITY: Fir Doiteain Armory cannot guarantee that the shipping carrier will not damage or lose your product, or that once delivered, your product will not be stolen or damaged. Once your product is delivered to the address you have provided, you assume all responsibility for its safety and hereby explicitly release Seventh Sea Industries, LLC (dba Fir Doiteain Armory) from all liability and responsibility thereafter. Shipping carriers offer their own guarantees for delivery and loss, Fir Doiteain Armory will assist in these claims whenever possible.
SHIPPING RESTRICTION: I understand that Seventh Sea Industries, LLC (dba Fir Doiteain Armory) does not ship outside the United States or to any area within the United States where Fir Doiteain Armory has determined that it is prohibited by Federal, State, or local law to ship product. If I attempt to have product shipped to these restricted areas, my order will be canceled and I will be subject to paying a restocking charge as described below in returns.
GOVERNING LAW: I understand and acknowledge that Montana law will govern exclusively: my purchase and use of any products from, any information I receive from, any legal action instituted against me, and any legal action that I institute, or that someone else institutes as a result of my actions against Seventh Sea Industries, LLC (dba Fir Doiteain Armory).
JURISDICTION: In the event that I choose to file a complaint against Seventh Sea Industries, LLC or any of its owners, agents, officers, or employees, I agree that such a complaint must be filed within a court located in Lewis & Clark County, Montana. I agree that any complaints filed within any other jurisdiction shall be immediately removed to a court within Lewis & Clark County, Montana and I agree to reimburse Seventh Sea Industries, LLC and its owners, agents, officers, and employees for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed within a court located in Lewis & Clark County, Montana.
RELEASE OF LIABILITY AND AGREEMENT TO INDEMNIFY AND DEFEND: In the event that any of the statements under the “Customer Affidavit” section of these Terms and Conditions are determined to be untrue, I will release, hold harmless, indemnify, and pay to defend Seventh Sea Industries, LLC (dba Fir Doiteain Armory) and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.
By entering into a transaction with Seventh Sea Industries, LLC (dba Fir Doiteain Armory), I understand and acknowledge that I alone am responsible for how the product I purchased is used by me and by any other party. I explicitly agree to release, hold harmless, indemnify, and pay to defend Seventh Sea Industries, LLC (dba Fir Doiteain Armory), its owners, agents, officers, and employees against any resulting damages and/or civil liability or criminal prosecution arising from or related to the products I have purchased, to include, but not limited to, the use of the product, the storage of the product, and the transportation of the product. In the event that any other party files a claim of any kind against Seventh Sea Industries, LLC, I will indemnify and pay to defend Seventh Sea Industries, LLC and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.
CASH or CHECK: Prices do not typically reflect a discount for paying directly with cash, money order, or check (without use of a credit card or payment service). Any advertised Cash price will be clearly marked. If you wish to pay by bank check or money order, subtract the Processing Charge from our invoice and remit payment to our mailing address with a copy of the invoice. We will notify you when your payment clears and the merchandise is ready for pickup. Depending on the type of check (e.g. personal vs. certified), this could be ten (10) business days or more. PLEASE remember to verify and/or include your contact information, if not already correct in the Bill To and Ship To section of the invoice. DO NOT MAIL CASH (local customers may contact us to arrange for a cash payment). You hereby authorize Seventh Sea Industries, LLC (dba Fir Doiteain Armory) to convert your check to an ACH/EFT payment if available.
WARRANTY: Fir Doiteain Armory is not a warranty repair station. As such, no warranties, whether of merchantability or fitness for any purpose, or otherwise, whatsoever by Seventh Sea Industries, LLC (dba Fir Doiteain Armory) are expressed or implied. Manufacturers provide warranties in many instances and are included in the manufacturer's packaging. All requests for warranty information, repairs, and claims should be made directly to the manufacturer. All other items are sold AS-IS.
RETURNS: All firearm and ammunition sales are final. Due to the unique nature of our business we only accept returns for other products within 15 days of the delivery date. Return shipping charges are the responsibility of the customer in ALL instances except one in which we shipped you the incorrect item due to our error. Tracking and insurance are recommended when shipping product. There will be no refund issued for any returns that are received at our facility without a prior approved Return Merchandise Authorization (RMA) number on file or for any returns that are received at our facility with a prior declined RMA on file. If you would like your unauthorized return that we received, we will collect additional payment from you to cover the costs to ship the product back to you. RMA numbers are only valid for two (2) weeks. ABSOLUTELY NO RETURNS ARE ACCEPTED UNLESS THE GOODS ARE IN THE UNDAMAGED ORIGINAL CARTONS IN RESALABLE CONDITION. Replacement or refund is at the sole discretion of Fir Doiteain Armory.
SHIPPING DAMAGE: If you receive a damaged shipment, or suspect a shipment is damaged, notify carrier (FedEx, UPS, etc.) and Fir Doiteain Armory immediately. IMPORTANT: Before a carrier will process any claim, its representative must inspect the merchandise and the shipping carton. It is also critical that you sign the bill of lading as damaged or short at the time of delivery. Shipping damages should be photographed prior to opening. Damaged packages should be opened in the carriers presence if at all possible or delivery refused. DO NOT DISCARD OR DESTROY ANY SHIPPING CARTONS.

SPECIAL ORDERS: Must be secured with a down-payment of 50% of the product's predicted cost. Due to recent market volatility, we are unable to guarantee product cost and/or availability until the order is actually placed with our suppliers. If the actual price is higher than the predicted price, Fir Doiteain Armory will contact you prior to placing the order. Special orders may not be canceled without a 30% special order cost recovery charge. This includes customers who are denied transfer in conjunction with State and/or Federal background checks related to special order firearm purchases. Firearms will only be held for twenty (20) calendar days while you may attempt to remedy the situation with State or Federal Authorities. Transfer Fee(s) may be charged each time an attempt is made for a background check.
TRANSFER FEES: If you are a using another FFL dealer to purchase a firearm though Fir Doiteain Armory, be aware that your dealer will charge you a transfer fee. This fee is in addition to the charges incurred with Fir Doiteain Armory. You should always inspect your firearm(s) PRIOR to completing the transfer with your dealer to whom the firearm(s) was shipped. Fees charged by a dealer transferring a firearm to the end user will not be refunded by Fir Doiteain Armory for any reason. These transactions are at the full risk and expense of the consumer. We must have a copy of the FFL Dealer's license on file prior to shipment and they must be aware of the incoming shipment and transfer.
If you are transferring a firearm into Fir Doiteain Armory for disbursement to you as the end user, all shipments must be prepaid. COD or postage due deliveries will be refused. Any costs incurred beyond receiving the delivery and the initial background check are the responsibility of the buyer and must be paid prior to the transfer or return of product. Checks will be held as per the CASH or CHECK section above. You MUST notify Fir Doiteain Armory with your intent to transfer and an Invoice will be created to help limit the time it may take to process you payment choice.
If you are assessed a Transfer Fee on our invoice, please be aware that it exists to cover our costs related to transferring a firearm to you the end-user, such as receiving inventory, State and/or Federal background checks, etc. It will not be refunded if you do not pass the background check required in order to release the firearm to you. It is separate from the other costs incurred with order processing, such as, a restocking charge. The ONLY circumstance where a Transfer Fee may be refunded, is if the product for transfer did not arrive in inventory.
